DMCA Policy

Semi-Final Hope respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which can be found on the U.S. Copyright Office website, Semi-Final Hope will respond expeditiously to claims of copyright infringement committed using the Semi-Final Hope service and/or the Semi-Final Hope website (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

This policy outlines the information required to submit a notification of alleged infringement to Semi-Final Hope, as well as the process for submitting a counter-notification if you believe your content was wrongly removed.

Filing a DMCA Notice (Takedown Request)

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

Upon receipt of the Notice as described below, Semi-Final Hope will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.

  1. Identification of the copyrighted work claimed to have been infringed: Provide a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity: Provide a description of the infringing material and information reasonably sufficient to permit Semi-Final Hope to locate the material on the Site. This should include the URL(s) of the specific content you claim infringes your copyright.
  3. Information reasonably sufficient to permit Semi-Final Hope to contact you: This includes your name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Your physical or electronic signature.

Counter-Notification

If you believe that the material you posted on the Site was removed or disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our Designated Copyright Agent. Pursuant to the DMCA, the Counter-Notification must include substantially the following:

  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., specific URL(s)).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the U.S., for any judicial district in which Semi-Final Hope may be found, and that you will accept service of process from the person who provided the initial DMCA notification or an agent of such person.
  • Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, Semi-Final Hope will promptly provide the person who submitted the original DMCA notification with a copy of the Counter-Notification and inform that person that Semi-Final Hope will replace the removed material or cease disabling access to it in 10 business days. If Semi-Final Hope's Designated Copyright Agent does not receive notice from the original DMCA claimant that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity related to the material on Semi-Final Hope's system within 10 to 14 business days or more following receipt of the Counter-Notification, Semi-Final Hope may replace the removed material or cease disabling access to it, in its sole discretion.
